Artificial intelligence is rapidly reshaping the entertainment industry, influencing everything from content creation to contract negotiation. As studios, performers, and production companies adopt AI-driven tools, new legal and contractual questions are emerging. The intersection of artificial intelligence, entertainment law, and technological innovation now demands careful examination, particularly in areas involving contract review, statutory protections, and artists’ rights in the digital age.

In this in-person presentation within the At Large track, Tabitha Zapalski, Christopher Zapalski, and Laura Zapalski explore how AI is transforming contract law and legal frameworks in the music and film industries. Drawing from case law, legislative developments, and qualitative analysis, the session examines how traditional common law principles such as offer, acceptance, consideration, capacity, substantial performance, and material breach are being tested by emerging technologies.

The presentation highlights key legal risks associated with AI-assisted contract drafting and review, including issues of unauthorized image use, digital replication, employment contract modifications, and mitigation of damages. By analyzing notable case precedents and recent legislative initiatives, the authors evaluate how courts and policymakers are responding to technological disruption.
